THE OVERLAY KING DIGITAL DELIVERY POLICY
Effective Date: July 1, 2020
This Digital Delivery Policy explains how The Overlay King processes and delivers ready-made digital products, custom-project deliverables, Setup Lab appointment information, and other electronically provided products or services.
The Overlay King currently sells digital products and electronically delivered services. No physical product will be shipped unless a product listing expressly states otherwise.
This Digital Delivery Policy should be read together with The Overlay King’s Return and Refund Policy, Privacy Policy, Privacy Practices Addendum, applicable product license, approved custom-project scope, and Terms of Service.
1. ELECTRONIC DELIVERY ONLY
Products and services sold through The Overlay King are delivered electronically.
Electronic delivery may include:
• An emailed download link.
• Access through an order-confirmation or order-status page.
• A private access link.
• An email attachment.
• An approved cloud-storage link.
• A booking or appointment confirmation.
• A video-meeting link.
• A direct electronic file transfer.
• Another electronic method communicated for the applicable product, project, or service.
No physical package, printed product, storage device, disc, or other physical item is included unless the applicable product listing expressly states otherwise.
Customers will not receive a physical shipping or tracking number for an electronically delivered product or service.
2. READY-MADE DIGITAL PRODUCTS
Ready-made digital products include completed products that are available for purchase without a separate custom-production process.
Examples may include:
• Virtual rooms.
• Stream overlays.
• Cutout overlays.
• Stream effects.
• Animated elements.
• Alerts.
• Graphics.
• Templates.
• Digital creator assets.
• Other downloadable visual products.
Ready-made digital products are delivered through the electronic-delivery method assigned to the product.
Delivery may occur through:
• A download or access link sent to the email address used at checkout.
• A link displayed on the order-confirmation page.
• A link displayed on the order-status page.
• Another electronic-delivery method identified during or after checkout.
3. READY-MADE PRODUCT DELIVERY TIME
Ready-made digital products are usually delivered within 15 minutes after successful payment confirmation.
Customers should allow up to 24 hours for standard electronic delivery.
Delivery may take longer when:
• Payment is pending.
• Payment has not been successfully confirmed.
• The order requires a fraud or security review.
• The product is configured for manual fulfillment.
• Additional order verification is reasonably required.
• An incorrect or inaccessible email address was submitted.
• The delivery email is filtered into spam, junk, promotions, or quarantine.
• The digital-delivery provider experiences an interruption.
• Shopify, the payment provider, or another service provider experiences an interruption.
• A technical or security issue affects the order.
A customer who has not received access after 24 hours should submit a Product or Order Support request through The Overlay King’s Contact page.
4. BEFORE REPORTING A DELIVERY PROBLEM
Before contacting support, the customer should:
• Confirm that payment was successfully completed.
• Check the inbox associated with the email address used at checkout.
• Check spam, junk, promotions, quarantine, and filtered folders.
• Search the inbox for the order confirmation and delivery message.
• Review the order-confirmation page.
• Review the order-status page when available.
• Confirm that the submitted email address was complete and accurate.
• Allow up to 24 hours after successful payment confirmation.
A filtered, overlooked, or deleted delivery email does not automatically establish that electronic delivery failed.
After the order is verified, The Overlay King may provide reasonable redelivery assistance when the product remains available and the order remains valid.
5. DOWNLOAD LIMITS
Ready-made digital products may include up to five download attempts for each purchased product unless a different limit is displayed or communicated at the time of purchase.
Download limits are used to:
• Protect licensed digital files.
• Reduce unauthorized sharing.
• Prevent public distribution.
• Identify suspicious access activity.
• Maintain reasonable file-hosting usage.
A customer who reaches the applicable download limit may submit a support request.
After verifying the customer and order, The Overlay King may reactivate access, renew the download allowance, or resend the delivery link when reasonably available.
Access restoration is not guaranteed when:
• The order cannot be verified.
• The purchase was refunded or reversed.
• A payment dispute remains unresolved.
• The file is no longer reasonably available.
• Unauthorized distribution is suspected.
• The request conflicts with the applicable license or store terms.
6. CUSTOMER BACKUP RESPONSIBILITY
Customers are responsible for:
• Downloading purchased files promptly.
• Confirming that the files open correctly.
• Extracting compressed files when required.
• Securely storing the original files.
• Maintaining backup copies.
• Protecting download and access links.
• Preventing unauthorized access to the files.
The Overlay King does not guarantee:
• Indefinite file hosting.
• Permanent download access.
• Permanent access-link availability.
• Future replacement availability.
• Recovery of files deleted from the customer’s device.
• Continued availability after the applicable retention period.
• Continued compatibility with future third-party software changes.
Customers should not rely on The Overlay King’s delivery platform as their permanent file-storage system.
7. DOWNLOAD AND ACCESS-LINK RESTRICTIONS
Download links and access links are issued for use by the purchasing customer.
A customer may not:
• Post a download link publicly.
• Share a download link with another person.
• Transfer an access link to an unrelated recipient.
• Resell an access link.
• Sublicense an access link.
• Publish the delivered files for unrestricted download.
• Circumvent an established download limit.
• Use multiple identities or email addresses to avoid access controls.
• Distribute the product in violation of its applicable license.
The Overlay King may deactivate a download or access link when there is reasonable evidence of:
• Unauthorized sharing.
• Public posting.
• Resale or redistribution.
• Excessive or suspicious access activity.
• Fraud.
• Chargeback abuse.
• Account compromise.
• License violations.
• Another violation of the applicable store terms.
8. CUSTOM-PROJECT DELIVERY
Custom-project deliverables are released after:
• The client approves the final proof.
• All required revisions within the approved scope are completed.
• The remaining project balance is paid.
• Any required client information or approval is received.
Unless a different timeline appears in the approved project scope, final custom-project files are usually delivered within two business days after both final approval and confirmed final payment.
Delivery may occur through:
• An email attachment.
• A private download link.
• An approved cloud-storage link.
• A direct electronic transfer.
• Another secure electronic method communicated for the project.
The delivery email, file-transfer message, cloud-storage message, or other project communication containing the final files or access information serves as the official delivery record.
9. CUSTOM-PROJECT DELIVERABLES
The customer will receive only the deliverables included in the approved project scope.
The approved scope may identify:
• File formats.
• Dimensions.
• Versions.
• Platforms.
• Number of scenes or layouts.
• Static or animated deliverables.
• Included revisions.
• Installation or setup services.
• Delivery requirements.
• Source-file availability.
The following are not included unless expressly stated in the approved project scope:
• Editable source files.
• Working production files.
• Layered project files.
• Templates.
• Raw animation projects.
• Software-specific project files.
• Fonts.
• Stock assets.
• Licensed third-party elements.
• Alternate sizes.
• Alternate formats.
• Future conversions.
• Future compatibility updates.
• Installation assistance.
• Additional customization.
Final custom-project files are based on the approved final proof and approved project scope.
10. CUSTOM-PROJECT DELIVERY REVIEW
Customers must review custom-project deliverables promptly.
The following issues must be reported within seven calendar days after delivery:
• Missing files.
• Corrupt files.
• Files that cannot be opened because the delivered file is defective.
• Incorrect formats compared with the approved scope.
• Missing versions included in the approved scope.
• A material difference from the approved final proof.
• An access link that does not function.
The customer should include:
• The project or order number.
• The customer’s name.
• The purchasing email address.
• The affected file or deliverable.
• A description of the problem.
• A screenshot or error message when applicable.
Verified delivery problems will first be addressed through:
• Troubleshooting.
• Repair.
• Replacement.
• Corrected files.
• Renewed access.
• Alternative delivery.
• Redelivery.
Refund eligibility remains governed by the published Return and Refund Policy.
11. SETUP LAB CONFIRMATIONS
Setup Lab services are electronically delivered services and do not include physical shipping.
Full payment is required to reserve a Setup Lab appointment.
An appointment is considered confirmed when the customer receives written confirmation showing:
• The selected service.
• The scheduled date.
• The scheduled time.
• The applicable time zone.
• The customer’s booking information.
A Shopify order receipt alone does not replace the separate appointment confirmation when scheduling is completed through another page, application, email, or communication method.
The customer is responsible for reviewing the confirmation and promptly reporting an incorrect service, date, time, time zone, or email address.
12. SETUP LAB MEETING ACCESS
The Setup Lab meeting link and applicable preparation instructions will normally be:
• Included with the booking confirmation; or
• Delivered electronically no later than 24 hours before the scheduled session.
A customer who has not received the meeting link within 24 hours of the appointment should:
• Check the email address used for the booking.
• Check spam, junk, promotions, quarantine, and filtered folders.
• Review the booking confirmation.
• Confirm the scheduled date and time zone.
• Contact The Overlay King immediately.
Rescheduling, late arrival, missed appointments, customer-caused technical problems, and appointments canceled by The Overlay King are governed by the Return and Refund Policy and applicable service terms.
13. CUSTOMER EMAIL RESPONSIBILITY
Customers are responsible for providing a complete, accurate, accessible, and actively monitored email address during:
• Checkout.
• Account creation.
• Appointment booking.
• Project intake.
• Quote submission.
• Support communications.
The Overlay King is not responsible for an initial delivery delay caused by:
• An incorrect email address.
• An incomplete email address.
• A misspelled email address.
• An inaccessible email account.
• An abandoned email account.
• A full mailbox.
• Email filtering.
• A customer’s failure to review the submitted information.
Customers should add The Overlay King’s sending address to their approved contacts and review filtered folders before reporting a delivery failure.
14. EMAIL CORRECTIONS AND REDELIVERY
A customer who entered an incorrect email address must submit a support request containing:
• The order number.
• The purchasing name.
• The original purchasing email address.
• The corrected email address.
• The product or service purchased.
• The approximate purchase date.
• Any other information reasonably required to verify the order.
After verification, The Overlay King may update the applicable delivery information and resend:
• A download link.
• An access link.
• An appointment confirmation.
• A meeting link.
• Custom-project files.
• Another applicable delivery message.
The first verified email correction and redelivery request will not normally incur an additional charge.
The applicable delivery window begins again after the corrected information and required verification are received.
Repeated address changes, inconsistent information, suspicious requests, suspected fraud, or attempts to redirect licensed files to an unrelated person may require additional verification or may be denied.
15. FILE FORMATS AND COMPATIBILITY
Customers are responsible for reviewing the applicable product listing before purchase.
The product listing or approved project scope may identify:
• Included file formats.
• Required software.
• Supported platforms.
• Recommended hardware.
• Dimensions.
• Resolution.
• Orientation.
• File size.
• Setup requirements.
• Included deliverables.
• Compatibility limitations.
Customers are responsible for having the software, hardware, storage, internet access, and technical capability reasonably necessary to download and use the product.
A customer’s inability to use a correctly delivered product because of the following does not by itself establish that delivery failed:
• Unsupported software.
• Unsupported hardware.
• Use on an unlisted platform.
• Insufficient device storage.
• Lack of internet access.
• Failure to install required software.
• Failure to extract a compressed file.
• Lack of required technical knowledge.
• Modification of the delivered files.
• Failure to follow provided setup instructions.
16. COMPRESSED AND ARCHIVED FILES
Digital products may be delivered in ZIP or another compressed archive format.
The customer is responsible for having a compatible file-extraction tool.
Customers should:
• Download the complete archive.
• Allow the download to finish before opening it.
• Save an untouched copy of the original archive.
• Extract the files to a secure folder.
• Confirm that the extracted files open correctly.
• Create a backup before modifying or relocating files.
Customers should not rename, relocate, modify, overwrite, or delete the original files until the download has been successfully opened, extracted when necessary, and securely backed up.
17. REPORTING A READY-MADE PRODUCT PROBLEM
Missing files, corrupt archives, inaccessible files, incorrect formats compared with the published listing, or a material difference from the advertised deliverables must be reported within seven calendar days after delivery.
Submit the request through The Overlay King’s Contact page.
Select:
Product or Order Support
Include:
• Order number.
• Purchasing name.
• Purchasing email address.
• Product name.
• Purchase date.
• Description of the delivery problem.
• Screenshot or error message when applicable.
Do not submit:
• Complete payment-card numbers.
• Card-security codes.
• Passwords.
• Account-recovery codes.
• Backup codes.
• Private keys.
• Other sensitive account credentials.
Verified file-delivery problems will first be addressed through troubleshooting, repair, replacement, corrected files, renewed access, or redelivery.
18. FUTURE SOFTWARE AND PLATFORM CHANGES
The Overlay King does not control third-party:
• Livestreaming platforms.
• Social-media platforms.
• Broadcasting software.
• Operating systems.
• Plugins.
• Applications.
• Video codecs.
• Graphics software.
• Hardware.
• File-compression tools.
• Cloud-storage services.
The Overlay King does not guarantee that a digital product will remain compatible with future third-party updates.
Updated versions, converted formats, future compatibility work, technical customization, installation, and troubleshooting are not included unless expressly stated in:
• The product listing.
• Applicable license.
• Approved project scope.
• Setup Lab service description.
• Written service agreement.
A later third-party compatibility change does not automatically establish that the original electronic delivery failed.
19. PAYMENT CONFIRMATION
Electronic delivery depends on the associated order remaining valid and paid.
Delivery may be delayed or withheld when:
• Payment is pending.
• Payment fails.
• Payment is declined.
• Payment requires additional verification.
• The order is under fraud review.
• A payment dispute has been submitted.
• The order information cannot be verified.
• The transaction appears unauthorized.
A stated delivery window begins after successful payment confirmation and completion of any reasonably required verification.
20. REFUNDS, REVERSALS, AND CANCELED ORDERS
When an order is:
• Canceled.
• Fully refunded.
• Reversed.
• Determined to be fraudulent.
• Subject to a successful payment dispute.
The Overlay King may:
• Disable download links.
• Revoke access.
• Deny redelivery.
• Terminate the associated product license.
• Suspend related customer access.
A customer who receives a full refund, payment reversal, or cancellation that removes the product license must:
• Stop using the affected product.
• Delete downloaded copies.
• Delete extracted copies.
• Delete backup copies.
• Delete modified versions under the customer’s control.
• Stop displaying, distributing, or incorporating the product into new work.
Access revocation does not limit any other rights or remedies available under the applicable license, Terms of Service, Return and Refund Policy, or law.
21. CHARGEBACKS AND PAYMENT DISPUTES
Download access and future redelivery may be temporarily suspended while a chargeback, payment dispute, fraud review, or account-security concern is investigated.
The suspension may remain in effect until:
• The dispute is resolved.
• Payment is confirmed.
• The customer’s identity and order are verified.
• The security concern is addressed.
When a dispute is resolved in favor of The Overlay King and the order remains valid and fully paid, access may be restored after verification.
A customer should not use a chargeback as a substitute for first reporting a correctable delivery issue through the Contact page.
22. UNAUTHORIZED DISTRIBUTION
Unauthorized publication, resale, transfer, sublicensing, public posting, link sharing, or distribution may result in:
• Immediate access revocation.
• Cancellation of remaining download attempts.
• Denial of redelivery.
• Termination of the applicable license.
• Removal of access to affected products.
• Other remedies permitted by the applicable terms or law.
The purchasing customer is responsible for reasonably protecting delivered files and links from unauthorized access.
23. DELIVERY AND ACCESS RECORDS
The Overlay King may maintain reasonable electronic records documenting:
• Order number.
• Purchase date.
• Customer name.
• Purchasing email address.
• Product or service purchased.
• Payment status.
• Fulfillment status.
• Delivery-message date and time.
• Download-link issuance.
• Access-link issuance.
• Download activity.
• Access activity.
• Number of download attempts.
• Redelivery activity.
• Customer-support communications.
When supported by the delivery platform, records may also include:
• Access timestamps.
• Internet Protocol addresses.
• Browser information.
• Device information.
• Operating-system information.
These records may be used to:
• Verify fulfillment.
• Investigate delivery problems.
• Process support requests.
• Restore verified access.
• Enforce download limits.
• Prevent unauthorized sharing.
• Respond to refunds or payment disputes.
• Protect account security.
• Document completion of a transaction.
24. CUSTOM-PROJECT DELIVERY RECORDS
Custom-project delivery records may include:
• Approved project scope.
• Customer instructions.
• Revision communications.
• Final-proof approval.
• Payment confirmation.
• Delivery message.
• Private download link.
• Cloud-storage link.
• Delivered-file list.
• Delivery timestamp.
• Redelivery communications.
• Customer confirmation or support request.
These records may be used to document approval, delivery, project completion, support activity, or dispute resolution.
25. SETUP LAB DELIVERY RECORDS
Setup Lab records may include:
• Service selected.
• Payment confirmation.
• Scheduled date and time.
• Applicable time zone.
• Booking confirmation.
• Meeting-link delivery.
• Preparation instructions.
• Rescheduling history.
• Attendance information.
• Related customer communications.
These records may be used to confirm that appointment and access information was delivered electronically.
26. ORDER VERIFICATION
Before changing a delivery address, disclosing delivery records, restoring access, or resending licensed files, The Overlay King may request:
• Order number.
• Purchasing name.
• Original purchasing email address.
• Product or service purchased.
• Approximate purchase date.
• Non-sensitive transaction information.
• Other reasonable information needed to match the requester to the order.
Customers will not be required to provide:
• Account passwords.
• Complete payment-card numbers.
• Card-security codes.
• Recovery codes.
• Private keys.
• Unnecessary sensitive credentials.
Verification is used to protect customer information, digital files, and order access from unauthorized disclosure or redirection.
27. BUSINESS DAYS AND TIME ZONE
Unless otherwise stated, “business days” means Monday through Friday, excluding United States federal holidays.
Business-day calculations are based on Pacific Time.
Orders received outside normal business hours, on weekends, or on federal holidays may not begin a business-day processing period until the next business day.
Automated ready-made product delivery may still occur outside normal business hours when the configured delivery system is operating normally.
28. WHEN A DELIVERY PERIOD BEGINS
A stated delivery period begins only after all applicable prerequisites have been completed.
Prerequisites may include:
• Successful payment confirmation.
• Required fraud or security review.
• Customer identity verification.
• Receipt of an accurate email address.
• Final-proof approval.
• Final custom-project payment.
• Completion of appointment scheduling.
• Receipt of required customer files.
• Receipt of required customer instructions.
• Another customer action required by the applicable product or service.
A delay caused by an incomplete prerequisite does not count as part of The Overlay King’s stated delivery period.
29. TECHNICAL INTERRUPTIONS
Electronic delivery may occasionally be delayed by:
• Payment-processing interruptions.
• Fraud review.
• Incorrect customer information.
• Internet interruption.
• Email-delivery failure.
• Service-provider outage.
• File-hosting interruption.
• Platform maintenance.
• Corrupt uploads.
• Security concerns.
• Software failure.
• Another condition outside the normal delivery process.
A temporary technical interruption does not automatically mean that an order has permanently failed.
The Overlay King will make reasonable efforts to:
• Identify the problem.
• Restore access.
• Resend the delivery message.
• Repair or replace an affected file.
• Provide an updated link.
• Use another secure electronic delivery method.
• Communicate a material known delay.
30. ALTERNATIVE DELIVERY
When the original delivery method is unavailable or unsuccessful, The Overlay King may use another secure electronic method.
Alternative delivery may include:
• A corrected email.
• A renewed download link.
• A private access link.
• An approved cloud-storage link.
• A replacement archive.
• An email attachment.
• A direct electronic file transfer.
• Another method reasonably appropriate for the purchased product or service.
The customer may be required to complete reasonable order verification before alternative delivery is provided.
31. UNRESOLVED DELIVERY FAILURE
Customers must cooperate with reasonable verification and troubleshooting before a delivery failure can be confirmed.
Verified delivery problems will first be addressed through:
• Troubleshooting.
• Repair.
• Corrected files.
• Replacement.
• Renewed access.
• Alternative delivery.
• Redelivery.
When The Overlay King cannot reasonably provide the purchased product or service after a verified delivery failure, the affected purchase may qualify for cancellation or refund under the published Return and Refund Policy.
32. PRIVACY AND DELIVERY INFORMATION
Delivery, access, booking, approval, verification, and redelivery records are handled according to The Overlay King’s:
• Privacy Policy.
• Privacy Practices Addendum.
• Applicable legal obligations.
Records are retained only as reasonably necessary for:
• Transactions.
• Product or service delivery.
• Customer support.
• Fraud prevention.
• Accounting.
• Security.
• Contract documentation.
• Dispute resolution.
• Legal compliance.
33. APPLICABLE CONSUMER RIGHTS
Nothing in this Digital Delivery Policy limits consumer rights or remedies that cannot legally be waived.
Requirements and rights may differ depending on the customer’s location.
When an applicable law provides a customer with greater protection than this policy, the applicable legal requirement will control.
34. POLICY UPDATES
The Overlay King may update this Digital Delivery Policy to reflect changes to:
• Products.
• Services.
• Delivery applications.
• Fulfillment procedures.
• Technology.
• Service providers.
• Security requirements.
• Business operations.
• Legal obligations.
The effective date will be updated when the policy changes.
Unless otherwise required by law or reasonably necessary to address fraud, security, unauthorized access, technical misuse, or a delivery-system change, a purchase will generally remain subject to the material delivery terms published when the order was placed.
A policy update does not remove refund, privacy, or consumer rights that cannot legally be waived.
35. DELIVERY SUPPORT
Customers may report a delivery problem through The Overlay King’s Contact page.
Select:
Product or Order Support
Include:
• Order number.
• Purchasing name.
• Purchasing email address.
• Product or service purchased.
• Purchase date.
• Description of the delivery problem.
• Screenshot or error message when applicable.
Do not submit complete payment-card information, card-security codes, passwords, recovery codes, private keys, or other sensitive credentials.
